is going to break it down for us. what do these plans do with all that money? >> first off, the $50 billion infrastructure program would rebuild or build 150,000 miles of road, 4000 miles of railroad track, 115 miles of airport runways. essentially, that would be paid for with taxes on the oil and gas industries. it's a six-year program, no new jobs created immediately, and much of the criticism is that it is essentially a payoff to the unions. there is a second plan to be unveiled tomorrow, the "wall street journal" saying that this is a $200 billion plan, $200 billion worth of tax breaks for businesses. it would speed up the writeoff, for example, bill, you spend $10,000 on a computer right now, and immediately, that $10,000 comes off your business income, taxable business income. overall, no new jobs created immediately, some say that this is the president scrambling because his polls on the economy are looking very, very bad, and both of those plans would require a vote in congress, which is not likely. bill: wow, so here we are, post labor day. i can't think of a bigger issue in the co

for joining us. one east bay neighborhood is waking up to closed streets, construction equipment and a watery mess. terry mcsweeney joins us live from pleasant hill with the latest on a frustrating water main break. what we call breaking news. terry? >> double breaker. broke eight days ago, broke last night here near cay cay way. they've still got the water coming out of the ground here. they say they're doing that to stabilize the pressure and they do have water back to the 40 homes and 100 plus people who were without water, again, since about 7:30 last night. not news to the people out here. it was eight days ago, the very same pipe broke in a different spot but the very same pipe broke. they were without water yet again. crews have come out. they have circumvented the break and getting water to the homes. the street though is in a very, very interesting location. four schools are located near here, including diablo valley college. so in about an hour or so, students start walking, parents start driving their kids to school and this becomes a very busy street. they hope to have the street

for brown. did he not win his argument today on the bigger issue, whether the drugs the state uses is cruel and unusual punishment and whether making brown choose how he wants to die is constitutional. attorneys for albert greenwood brown argued his execution should be put on hold. first offering him a choice between one drug and a three-drug method violated state regulations. >> this is not proper. >> and second that the method might still cause him pain, considered cruel and unusual punishment though it's just been updated to eliminate that argument. the state argued brown was given a choice by order of a judge and lawyers failed to show evidence of possible pain from the three-drug method. >> the judge refused to block the execution based on arguments. >> he has not demonstrated he's likely to prevail at this time. applications will restraint order is denied. >> brown convicted in 1982 for the 1980 rape and murder of a riverside teenager, susan jordan. if it goes as scheduled it would be the first california execution since being put on hold in 2006 over a concern about flaws in the inje

that would apply for the one set on wednesday. >> understate law the department of crepes said it would use a three-drug procedure in regulations they spent years creating. those regulations have force of law and so judge fogel is saying you can either have your rights unthe constitution protected and understate law protected but not both. it's completely unfair. >> reporter: the same judge, judge jeremy fogel, was the one who halted executions in california in 2006. it claimed procedures for the three drug cocktail aimed at killing the condemned was not clear, and the death chamber was too dimly lit to monitor the procedure. but the judge is now allowing the executions to proceed because of a supreme court ruling in 2008 which upheld lethal injections in the state of kentucky and because ohio and washington state have been using 1-drug executions for the past year with no reported problems. that even as fogel presides over a lawsuit challenging the same procedure. brown has filed an appeal with the ninth circuit court. what they plan to do if all stays of execution fail. craig devro, san q
